This legislation is being amended. According to the Government of Ontario, the amendments

  • Allow “[a]n assessor appointed by the Corporation...to impose an administrative penalty on a person if the assessor is satisfied that the person has contravened...the Act or the regulations, a restriction, limitation or condition of a prescribed authorization or a prescribed Minister’s order or a prescribed director’s order”.
  • Allow “[t]he Lieutenant Governor in Council [to] make regulations governing standards of availability for elevating devices...including standards...and time requirements for their repair, governing the reporting of outages...and requiring a director to establish...accessible databases of information”.

These amendments come into force on May 7, 2018 and a date yet to be announced. More information is available here and here. At the time of publication of this alert, the online version of the legislation had not been updated.
